X Sues Operation Bluebird and Reasserts Rights to the 'Twitter' Name

Legal analysts say proving abandonment will be difficult, with a USPTO challenge and a Delaware case moving in parallel.

Overview

  • X filed a trademark infringement suit in Delaware federal court seeking to block Operation Bluebird from using or registering Twitter-related marks and requesting damages.
  • X updated its Terms of Service to explicitly reserve the Twitter trademarks and bar their use without consent, with the changes taking effect on January 15, 2026.
  • Operation Bluebird petitioned the USPTO on December 2 to cancel X’s federal registrations for “Twitter” and “Tweet” and applied to register “Twitter” for a planned site at twitter.new.
  • In its complaint, X argues the brand was not abandoned, citing continued public references, enforcement of legacy marks, and more than four million users accessing the service via twitter.com as of December 11, 2025.
  • Operation Bluebird, led by founder Michael Peroff and former Twitter trademark lawyer Stephen Coates, says it expects to prevail and reports roughly 145,000–150,000 handle reservations for its proposed platform.
