Wyden Urges Independent Review of Federal Courts’ Cybersecurity After Reported Breach of Sealed Cases

Reports say hackers accessed sealed filings using flaws known since 2020.

Overview

  • In a letter to Chief Justice John Roberts, Sen. Ron Wyden called for an outside assessment and recommended the National Academy of Sciences to lead it.
  • Wyden accused the judiciary of negligence and incompetence, alleging a cover-up and criticizing its slow move to phishing-resistant multifactor authentication.
  • Recent media reports said hackers with ties to Russia were at least partly responsible for the intrusion that exposed confidential court documents.
  • The Administrative Office of the U.S. Courts acknowledged on Aug. 7 that it was taking steps in response to sophisticated, persistent cyberattacks on its case management system.
  • The incident echoes a 2020 breach involving the CM/ECF and PACER platforms, with the latest compromise reportedly first detected around July 5.
