WASPI Judicial Review Set for 9–10 December as Government Files Defence

The case will test whether ministers acted lawfully in rejecting the ombudsman's compensation recommendation.

  • Government lawyers are serving extensive defence papers, including Detailed Grounds of Resistance, to WASPI's legal team ahead of the hearing.
  • The High Court will assess the legal rationality of the Government's response to the PHSO's final report on State Pension age changes.
  • Even if the challenge succeeds, the court could only require ministers to reconsider their decision rather than order compensation.
  • The PHSO found maladministration and recommended payments of £1,000 to £2,950 per woman, a proposal rejected in December 2024 on cost and awareness grounds.
  • An estimated 3.5 million women were affected, WASPI’s CrowdJustice fund has topped £240,000, and the campaign expects a judgment in spring 2026.
