Walter Delgatti Transferred From Tremembé to Potim Prison

Prosecutors have urged a shift to the semi-open regime, leaving Minister Alexandre de Moraes to rule on the request.

Overview

  • Delgatti was moved in December 2025 and is now serving an 8-year, 3-month sentence at Penitenciária 2 de Potim in São Paulo state.
  • The São Paulo Prison Administration said all closed-regime inmates were relocated from the Tremembé facility.
  • The Supreme Federal Court convicted Delgatti for inserting false documents into the CNJ system, including a fake order targeting Justice Alexandre de Moraes, which the court said sought to undermine the judiciary and the 2022 election.
  • In December, the Prosecutor-General’s Office supported his progression to the semi-open regime, citing at least 20% of the sentence served and good behavior, with no deadline for Moraes’s decision.
  • He also holds a separate first-instance 20-year conviction in the Operation Spoofing case, which remains under appeal at the federal court in Brasília.
