  • Walmart agreed to pay $16,000 in fines and fees for shipping at least nine realistic-looking toy guns to New York addresses in breach of the state’s toy gun ban.
  • New York’s 2015 law mandates that toy guns be brightly colored or transparent to distinguish them from real firearms and imposes a $1,000 penalty per violation.
  • An AG investigation found that between March 2020 and November 2023, at least 46 imitation weapons violating the ban were purchased through Walmart’s online marketplace.
  • Under the settlement, Walmart must terminate any third-party seller after three violations and implement policies and procedures to prevent future prohibited listings.
  • Walmart spokesperson Kelly Hellbusch said the company is committed to legal compliance and will enhance oversight of third-party marketplace offerings.
