Overview
- A three-judge Court of Appeal bench — Karin Emerton, Phillip Priest and Peter Kidd — unanimously set aside the 2024 verdict for Carol Clay’s murder and directed a new trial.
- The court found there were “serious irregularities” in the original trial amounting to a substantial miscarriage of justice, with detailed reasons yet to be published.
- Greg Lynn was remanded in custody to return to the Supreme Court on 28 January 2026 for a directions hearing, and any bail application remains outstanding.
- During the appeal, judges asked prosecutors whether alternative manslaughter charges might be pursued at a retrial, a matter the Director of Public Prosecutions is considering.
- Lynn’s appeal challenged prosecutorial conduct and disputed ballistics testimony, after a jury in 2024 convicted him over Clay’s death but acquitted him over Russell Hill.
