- Edelson PC filed 30 additional complaints on Wednesday, bringing the total to about 37 separate suits tied to the Feb. 10, 2026 Tumbler Ridge school shooting and expanding the pool of plaintiffs to include teachers, a principal and students.
- For the first time the new filings upgrade claims from negligence to aiding and abetting, a theory that requires proof the company knowingly facilitated the shooter and is likely to face early dismissal challenges over intent.
- Plaintiffs allege OpenAI employees flagged shooter Jesse Van Rootselaar’s ChatGPT account in June 2025 and urged notifying Canadian authorities, but leadership chose not to call police and only deactivated the account, which the complaint says the shooter then re-created.
- The suits demand full disclosure of the shooter’s ChatGPT logs and internal chain-of-command documents and seek injunctive relief to force changes to OpenAI’s safety processes in addition to more than $1 billion in combined damages.
- OpenAI says the account did not meet its threshold for an imminent and credible risk and disputes reporting about individual executives’ roles, setting up cross-border discovery fights and contested motions over evidence and legal theory.
