Overview
- On Friday, STF President Edson Fachin removed Moraes’s request from the long-running inquérito das fake news and opened a new procedure to place material about messages and a Police Federal (PF) intelligence report under his supervision.
- Fachin gave Alexandre de Moraes, André Mendonça, Prosecutor‑General Paulo Gonet and PF director Andrei Rodrigues five business days to provide formal explanations and asked the PGR to file an opinion in the same period.
- The PF report used by Moraes is unsigned, labeled a "documento de trabalho" and marked as having restricted diffusion and no probative value, with many conclusions flagged as low confidence in the document itself.
- Fachin said he wants a firm but careful response, advocated ending the inquérito das fake news as part of reforms, and indicated he is likely to submit the matter to the plenary so the full court can decide how to proceed.
- The dispute has spilled into campaign politics and could lead to several outcomes: dismissal, more evidence gathering, plenary rulings on admissibility and evidence, or—if crimes of responsibility are alleged—procedures that could reach the Senate.
