Overview

  • The new rule, signed by acting General Counsel Ralph Linden on July 10, phases out the “socially disadvantaged” designation that prioritized minority and female farmers in loan, commodity and conservation programs.
  • USDA will continue to offer enhanced terms exclusively to beginning farmers and military veterans under its farm loan and assistance initiatives.
  • The policy change implements President Trump’s January 2021 executive order to end race- and gender-based diversity, equity and inclusion policies across federal agencies.
  • Rep. Shontel Brown condemned the decision as a backward step that removes crucial support for Black, Indigenous and other farmers of color.
  • Legal challenges are ongoing, with the Wisconsin Institute for Law & Liberty arguing in federal court that any remaining preference provisions violate the Constitution’s Equal Protection Clause.
