USCIS Shifts CSPA Age Calculations to Final Action Dates

The update harmonizes USCIS practices with the State Department’s visa approval schedule.

Overview

  • Effective August 15, 2025, USCIS will use the Department of State Visa Bulletin’s Final Action Dates chart to calculate CSPA ages for all new adjustment of status and immigrant visa applications.
  • Adjustment of status requests filed before that date under the February 14, 2023 policy will retain their prior age calculations, and applicants with extraordinary circumstances may also qualify for the earlier rules.
  • For Indians in EB-2 and EB-3 categories, the shift poses a greater aging-out threat because Final Action Dates lag Dates for Filing by years or even decades in the backlog.
  • Children who age out under the new rule may need to switch to student (F-1) or other temporary visas while their parents pursue green cards, potentially separating family immigration paths.
  • Advocacy groups estimate up to 200,000 children and young adults face lost dependent status, prompting calls for additional transitional safeguards.
