USCIS Sets New Temporary TPS EAD Expiration Dates for Multiple Countries

Overview

• The U.S. Supreme Court’s June 25, 2026 ruling in Mullin v. Doe affirmed DHS authority to end Temporary Protected Status and prompted USCIS to change how it dates TPS-related work permits.
• On July 17, 2026 USCIS issued revised placeholder expiration dates for TPS-based Employment Authorization Documents, including July 24 for Somalia, Syria, Yemen and Haiti, July 27 for Burma/Myanmar, and July 30 for Ethiopia and South Sudan.
• USCIS says these dates are temporary, tied to active litigation, and do not represent final decisions on TPS designations or employment authorization; the agency may revise the dates with little notice.
• Employers should immediately review affected employees’ Form I-9 records, complete reverification where required, expect E-Verify alerts for A12 and C19 EAD codes, and prepare contingency staffing plans.
• Changes stem partly from the 2025 OBBA and DHS rules that shortened automatic EAD extensions and capped transitional extensions through July 22, 2026, creating legal and workforce uncertainty for hundreds of thousands of TPS holders.
