USCIS Proposes EB-5 Fee Cuts, Technology Surcharge and New Legacy Form

The plan pairs lower filing costs with a $95 technology fee to finance EB-5 system modernization.

Overview

  • DHS published a proposed rule on October 23 that opens a 60-day public comment period before USCIS finalizes an updated EB-5 fee schedule.
  • Initial petition fees for Forms I-526 and I-526E would drop to $9,625 each, including a new $95 technology fee, while Form I-829 would fall to $7,860.
  • Regional center fees would see major reductions, including Form I-956 to $28,895, I-956 amendments to $18,480, I-956F to $29,935, and I-956G to $2,740.
  • The proposal creates new charges for previously free filings—$55 for I-956H and $2,740 for I-956K—and introduces Form I-527 at $8,000 for certain legacy I-526 investors affected by terminations or debarments.
  • USCIS outlines derivative I-829 filing rules and reiterates processing targets from the 2022 Reform and Integrity Act, with the final rule to take effect 60 days after publication.
