USCIS and DHS Finalize FY2027 Immigration Fee Increases

Missing the new postmark cutoff will cause filing rejections that immediately affect applicants who do not include the updated fees.

Overview

  • USCIS published a Federal Register notice on September 30 and confirmed that selected fees will rise for filings postmarked October 16, 2026, so packages mailed that day or later must include the new amounts.
  • Key USCIS increases include the initial I-765 (EAD) from $560 to $570, the I-131 parole fee from $1,020 to $1,050, the I-821 TPS fee from $510 to $520, and the annual I-589 asylum fee from $102 to $105.
  • USCIS said the hikes come from H.R.1’s required annual inflation update using the CPI‑U for July 2025–July 2026 (about 3.36%), and statutory rounding rules mean some fees like the initial I-589, I-360 and Form I-94 remain unchanged.
  • Separately, DHS finalized a broad EB-5 investor fee overhaul that takes effect November 30, 2026, setting the I-526 fee at $7,615 and adding integrity and technology fees plus processing-time goals and stiffer penalties for regional centers.
  • The practical effect for applicants is immediate: incorrect payment will lead to returned or rejected filings, causing delays or lost filing dates, and the larger EB-5 fee rewrite could change who can afford investor petitions and how regional centers operate.
