U.S. Hits EB-1 Cap After EB-2, Freezing Top Employment Green Cards Until Oct. 1

  • No EB-1 or EB-2 immigrant visas or final approvals will be issued until the new fiscal year begins, though eligible applicants may file or keep adjustment cases pending if their priority dates are current.
  • Under the Immigration and Nationality Act, employment-based visas total 150,000 for FY2025, with EB-2 allotted 28.6% (about 42,900) and EB-1 subject to the same share.
  • Indian applicants face prolonged waits, with India’s EB-1 final action date stuck at February 15, 2022 in the September Visa Bulletin.
  • EB-5 for India advanced in August, but spillover from EB-4 and EB-5 was not enough to keep EB-1 and EB-2 open through the end of the fiscal year.
