US DOT Opens Process to Withdraw Aeroméxico–Delta Antitrust Immunity
The department contends Mexico’s 2022 reduction of landing slots at Mexico City airport breaches the 2016 air transport agreement underpinning the alliance’s immunity.

- On July 28 the DOT published its order in the Federal Register, formally initiating its proposal to revoke the alliance’s antitrust protection.
- Stakeholders have 14 days from July 19 to submit objections and seven business days thereafter to file replies before a final ruling.
- If no successful challenges emerge, the DOT will issue a final order and the joint venture’s immunity will expire on October 25, 2025.
- The department’s preliminary findings fault Mexico for cutting AICM’s hourly slots from 61 to 43 and mandating cargo operations at Felipe Ángeles International Airport.
- Delta and Aeroméxico are preparing a joint rebuttal and have requested an additional month to defend their antitrust immunity.
