Overview

  • On July 10, HHS formally published a Federal Register regulation that rescinds the 1998 interpretation of PRWORA and adds 13 programs—bringing the total to 44—barred to undocumented immigrants.
  • The Department of Education, Agriculture and Labor released parallel rules the same day to bar unauthorized migrants from Pell Grants, SNAP, workforce development services and other benefits.
  • All of the new regulations take effect immediately upon publication and are subject to a 30-day public comment period.
  • HHS estimates that reallocating Head Start slots to U.S. citizens could yield as much as $374 million in additional annual services.
  • Advocacy groups and state officials signaled plans for legal challenges and are closely watching how agencies will verify immigration status in enrollment and benefit processes.
