U.S. Announces Visa Ban Policy for Central Americans Who Act on Behalf of the CCP

The move uses INA Section 212(a)(3)(C) to bar those deemed to have worked for the CCP to erode rule of law.

Overview

  • The State Department announced a policy to restrict U.S. visas for Central American nationals who intentionally acted on behalf of the Chinese Communist Party to undermine rule of law.
  • Secretary of State Marco Rubio said targeted individuals and their immediate family members will be generally ineligible for entry to the United States.
  • The policy covers people who knowingly direct, authorize, fund, provide significant support to, or carry out the relevant activities in Central America.
  • Officials said they are taking steps to impose the restrictions on a number of individuals who have previously engaged in such conduct under Section 212(a)(3)(C) of the Immigration and Nationality Act.
  • The announcement named no individuals and listed no affected countries, and it framed the step as countering China’s influence in a region where several governments have shifted recognition to Beijing.
