UP Moves To Drop All Charges in 2015 Dadri Lynching Case

A fast-track court will now rule on the prosecutor’s Section 321 request.

Overview

  • The state has applied under Section 321 of the CrPC to withdraw the prosecution against all accused, including charges under IPC 302 and 307.
  • The application cites shifting eyewitness accounts, recovery limited to sticks, rods and bricks, and no evidence of prior enmity, and frames the move as serving equality and social harmony.
  • The filing references a 30 March 2017 Mathura forensic report that identified the seized meat as bovine.
  • Police first chargesheeted 15 people in 2015, naming Vishal Rana and cousin Shivam as principal accused, with a supplementary chargesheet later adding 19 more as the trial continues in the evidence stage.
  • Court consent is required for withdrawal, a 26 August state order and the Governor’s written permission preceded the filing, and objections from the complainant can be heard at a 12 December hearing.
