UCP Sues Ex-MLAs and Alberta Party Over Progressive Conservative Brand

The party says the 2017 unification transferred the PC brand to its association.

Overview

  • The United Conservative Association filed a Nov. 7 statement of claim in Alberta’s Court of King’s Bench naming Peter Guthrie, Scott Sinclair, the Alberta Party and its president Lindsay Amantea.
  • The lawsuit alleges passing-off on the Progressive Conservative Association of Alberta name and seeks declarations of trademark infringement and conspiracy.
  • The association also applied for an injunction to restrain the Chief Electoral Officer from approving any PC‑derivative party registration and to order removal and destruction of related promotional materials.
  • The claim seeks monetary damages including $500,000 as well as court orders addressing the use of the PC brand and associated goodwill.
  • Elections Alberta has not approved the Alberta Party’s late‑August vote to rename as the Alberta Progressive Conservative Party, while Guthrie denounces the suit as political intimidation and the UCP calls the rebrand misleading; none of the allegations have been tested in court.
