Two Students Allege Harassment by Trans Athlete in West Virginia Sports Case

The ACLU says a school inquiry found the claims unsubstantiated as Supreme Court arguments near.

Overview

  • Oral arguments are set for Jan. 13 in West Virginia v. B.P.J., a Supreme Court test of whether states may restrict girls’ teams based on biological sex under Title IX and equal-protection principles.
  • Bridgeport student Adaleia Cross alleges the athlete made sexually explicit remarks in the girls’ locker room during the 2022–23 school year, and she says she later quit high school track to avoid shared facilities.
  • The American Civil Liberties Union, which represents the athlete, says the student and parent deny the allegations and that a school investigation deemed the claims unsubstantiated.
  • Former Lincoln Middle School runner Emmy Salerno reports intimidation after refusing to compete in April 2024, citing staring, following at a basketball game, and a Snapchat post referencing her testosterone, and she says her team was later disqualified.
  • Alliance Defending Freedom, representing West Virginia and the Cross family, says Cross has provided sworn statements under penalty of perjury about the alleged incidents.
