Overview

• Manhattan DA Alvin Bragg unsealed an 11-count state indictment on August 6 charging Miguel Francisco Mora Nunez and Christhian Aybar-Berroa with attempted murder, assault, robbery and criminal weapons possession.
• The indictment follows the July 19 incident in Fort Washington Park where the two suspects allegedly robbed a woman’s phone and then shot at an off-duty CBP officer who returned fire.
• Bragg said the defendants planned the violent robbery spree via text messages before riding into the park on a moped.
• Both suspects face parallel federal charges and were identified by the Department of Homeland Security as undocumented migrants with prior criminal records, prompting calls for tougher sanctuary-city policies.
• The off-duty officer, shot in the face and arm, was treated at NYC Health + Hospitals/Harlem, is in stable condition and is expected to make a full recovery.
