Overview
- A liminar issued by TST relator Maurício Godinho Delgado on September 24 requires at least 60% of employees in each Caixa agency to remain working either in person or remotely and attaches a R$100,000 daily fine to each union that fails to comply.
- The court refused to declare the strike abusive and declined to bar peaceful protests or blockades, saying there was no evidence of excesses in the mobilization that began on September 10.
- Unions including Contraf-CUT and Contec filed contestations by September 26 asking the TST to review the 60% order and to guarantee wage protection, job security and no retaliation for striking workers.
- The core dispute remains the Saúde Caixa funding model: unions seek a return to a 70% employer/30% beneficiary split and an end to a 6.5% payroll cap while Caixa has offered a 9% ceiling from 2027 but preserved 6.5% in its court filing.
- The SDC of the TST will hold the final hearing on September 29, with the court provisionally keeping the 2024–2026 collective-agreement clauses in force and the outcome set to determine whether provisional staffing and contract proposals stand and how services for benefit payments and FGTS will be run.
