TSE Upholds Castro Conviction, Leaves Rio Succession to STF

By confirming his inelegibility without formally cassating his diploma the court has left the choice of Rio’s interim governor to the Supreme Court.

Overview

  • The TSE on Tuesday rejected appeals and unanimously upheld a March ruling that found ex-governor Cláudio Castro guilty of abuse of political and economic power and barred him from running until 2030.
  • The court’s findings point to massive irregular temporary hires tied to the 2022 campaign, with roughly 27,500 contracts at Ceperj and about 18,000 at Uerj alleged to have served as campaign workers and to have involved cash payments and diverted program funds.
  • By a 5–2 vote the TSE refused the Ministério Público Eleitoral’s request to record formal cassation of Castro’s electoral diploma after concluding the published decision did not show a majority for that sanction.
  • Because the ruling stopped short of formal cassation the Supreme Federal Court must now decide whether the mandato-tampão will be filled by a direct popular vote or by an indirect, secret ballot in the state assembly and the STF’s hearing remains paused on a minister’s pedido de vista.
  • Ricardo Couto continues as interim governor while parties including PSD and PL position for the short-term succession and separate moves such as the TCE-RJ’s recommendation to reject Castro’s 2025 accounts could trigger further legal or electoral consequences.
