Epps filed a defamation lawsuit against Fox News for spreading misinformation about his involvement.
The DOJ has now charged Epps with one count of disorderly conduct, contradicting allegations he was an FBI informant.
Over 850 defendants have been charged so far for crimes related to the Capitol attack, with hundreds pleading guilty.
