Trump loses immunity in Carroll defamation lawsuit, DOJ reverses position

  • The Department of Justice reversed its position that Trump was immune from liability in a defamation lawsuit filed by E. Jean Carroll.
  • Carroll accused Trump of sexual assault in the 1990s; Trump denied the allegations and insulted Carroll.
  • A jury found Trump liable for defaming and sexually abusing Carroll, awarding her $5 million in damages.
  • The DOJ now says Trump's remarks about Carroll were personal in nature, not made in an official capacity as president.
  • With no immunity, Trump will have to defend himself in Carroll's defamation suit set for trial in January 2024.
