Trump Administration to Scrap 30-Day Warning Before Immigration Fines

Published Friday, the rule will let DHS impose penalties of up to $1,000 per day on undocumented immigrants without prior notice.

  • The Departments of Justice and Homeland Security will eliminate the 30-day notice period so fines can begin immediately once an individual is found in the US illegally.
  • Penalties will range from $100 to $500 per unauthorized entry, climb to nearly $10,000 for failing to self-deport after a judge’s order, and reach $1,000 per day for defying a removal order.
  • DHS reported that as of June 13 it had issued 10,000 fine notifications to people residing in the country without legal status.
  • Undocumented immigrants who use the CBP Home app to arrange voluntary departure will have any outstanding fines waived under the new policy.
  • Assistant Secretary Tricia McLaughlin said the expedited penalties reflect DHS’s goal of enforcing immigration laws more effectively and deterring unlawful entry.
