Tribunal Rules for Darlington Nurses in Changing-Room Case Against NHS Trust

The judgment states the trust’s handling of access to the women’s changing room amounted to harassment that breached the nurses’ dignity.

Overview

  • The Newcastle employment tribunal found County Durham and Darlington NHS Foundation Trust liable for harassment related to sex and gender reassignment over access to the women’s changing room.
  • Judge James Sweeney wrote that requiring the nurses to share the facility with a biological male amounted to unwanted conduct that violated their dignity and created a hostile, humiliating and degrading environment.
  • The panel concluded that Rose Henderson did not personally harass or victimise colleagues.
  • The claim followed complaints raised in July 2023 that the nurses say were ignored by the trust, and the group pursued the case with support from the Christian Legal Centre.
  • The decision follows a separate ruling last month in which nurse Sandy Peggie won a partial victory against NHS Fife over changing facilities.
