TikTok Agrees to $400 Million Settlement Over Children's Data

The deal underscores U.S. enforcement of rules on child data and signals regulators will press tech firms to tighten age and parental controls.

Overview

  • The agreement, announced Friday, requires an immediate $300 million payment and a $100 million conditional payment that becomes due if a 2019 consent order tied to Musical.ly is vacated.
  • The Justice Department sued TikTok in 2024 on behalf of the FTC, alleging the platform allowed millions of users under 13 to create accounts and collected their personal information without parental consent.
  • The DOJ said TikTok has since put in place stronger age-verification tools and expanded parental supervision features, and described the settlement as a win for children and parents.
  • ByteDance completed a January transfer of parts of TikTok’s U.S. operations to a majority-U.S.-controlled entity backed by Oracle, Silver Lake and MGX, a corporate change cited by officials as relevant to resolving the case.
  • The settlement ends this DOJ action but does not halt many other pending lawsuits and regulatory probes over child safety and privacy that could lead to further penalties or business restrictions.
