Thanet Council to Vote on Reinstating £100 Swear Fines

Overview

  • Cabinet will debate the revised PSPO at a July 24 meeting that, if approved, runs for three years in Margate, Ramsgate and Broadstairs
  • Officers could issue £100 penalty notices for “foul or abusive” language loud enough to alarm or distress others, with a reduced £60 fee if paid within 14 days
  • The order also bans anti-social groups, misuse of public space, public drinking, urinating, defecating, spitting and use of legal psychoactive substances such as nitrous oxide
  • The PSPO includes a defence of “reasonable excuse” and explicitly preserves rights under Articles 10 and 11 of the Human Rights Act
  • Thanet Council revived the bid after Kent Police reported increased difficulties tackling antisocial behaviour since last year’s scheme was dropped following threats of legal action from the Free Speech Union
