Thane MACT Awards Rs 31.05 Lakh to Family of Carpenter Who Died After 2018 Crash

The order follows findings that the car was not mechanically defective, linking the 2018 crash to the victim’s paralysis and death.

Overview

  • MACT member R V Mohite held the driver negligent and directed the vehicle owner and Bajaj Allianz to pay compensation.
  • The tribunal awarded Rs 31,05,235 with 9% annual interest from the date of the petition until realization.
  • An RTO Thane inspection reported no braking-system defect, leading the tribunal to reject the defence’s handbrake or technical-fault claim and fault improper parking on a slope.
  • Records showed Manojkumar Sharma suffered paraplegia after the August 14, 2018 Upvan–Gandhinagar Road crash and died on December 24, 2020 following prolonged treatment.
  • The award is to be distributed as Rs 10,05,235 to the wife (including Rs 3 lakh in fixed deposit), Rs 2 lakh each to the parents, and Rs 8.5 lakh each to two sons in fixed deposits, with a charge sheet on rash driving noted against Prasanna Bhaguram Humane and Akash Shankarlal Prajapati.
