Thailand Clarifies Drinking-Hours Ban, Says Only Health Officials Can Issue Fines for Now

The health ministry says enforcement will emphasize education during a transition, with fines currently issued only by its officers.

Overview

  • The updated Alcoholic Beverage Control Act, in force since Nov 8, prohibits alcohol consumption in restaurants and commercial venues from midnight to 11am and from 2pm to 5pm.
  • Violations carry an administrative penalty of up to 10,000 baht, which applies to individuals as well as premises.
  • Police cannot impose fines until new sub-regulations are enacted, and repeat violations may trigger administrative action after initial warnings.
  • Licensed entertainment venues such as pubs, bars, hotels and international airport departure lounges are exempt, but smaller unlicensed restaurants and cafes must stop drinking during restricted hours.
  • The ministry is forming an Alcohol Control Board to draft detailed rules within a year, as business and tourism groups seek clarifications and urge changes to the 2pm–5pm restriction.
