Overview

  • Senate Bill 3, passed by both chambers, would outlaw all consumable hemp products containing THC and take effect September 1, 2025 if Gov. Abbott signs it into law.
  • House Bill 46 enlarges the Compassionate Use Program to cover chronic pain, terminal illness and hospice care while increasing dispensary licenses from three to 12 and permitting satellite locations.
  • Texas’s hemp industry, now worth up to $10 billion with more than 8,500 retailers and 50,000 jobs, warns that the ban would devastate businesses and tax revenue.
  • Lt. Gov. Dan Patrick has positioned the ban as a measure to protect children and public health, while opponents argue for regulation over an outright prohibition.
  • Gov. Abbott has not publicly committed on SB 3 and has until ten days after the legislative session ends to sign, veto or allow the ban to become law without his signature.
