Texas Attorney General Sues Biden Administration over Alleged Cutting of US-Mexico Border Wire
Federal agents accused of damaging state-owned border fencing in September, to the detriment of border security efforts, amid migration wave straining state and federal resources; Texas also alleged to have cut own wire for different reasons.
- Texas Attorney General Ken Paxton is suing the Biden administration claiming federal agents destroyed concertina wire at the Mexico-US border, undermining Texas's border security efforts. Paxton asserts this action destroyed property owned by Texas and enabled illegal entry into the state.
- The lawsuit also involves the Department of Homeland Security, US Customs and Border Protection, US Border Patrol, and several individuals within these bodies. The DHS refrained from commenting on ongoing litigation, but highlighted that Border Patrol agents are obliged to act when conditions put migrants or agents at risk.
- Despite Texas's outrage, it was revealed that the state had also cut its own wire earlier in July 2023 for emergencies like assisting individuals in medical distress or handling acts of violence. This action was brought to light in an email released by the Texas Department of Public Safety.
- Ken Paxton is seeking a court injunction to prevent the defendants from damaging property that is not theirs, in violation of both state and federal laws. This lawsuit follows increasing apprehensions at the US-Mexico border, straining state and federal resources and escalating issues between Texas and the Biden administration over border security.
- Texas's methods for deterring illegal migrants, such as installing floating barriers in the Rio Grande, have faced legal challenges in the recent past. The Justice Department sued Texas in July over these tactics, resulting in ongoing litigation in the 5th US Circuit Court of Appeals.
