TEPJF Orders Poza Rica Recount After 5–2 Ruling

The majority left intact prior rulings by treating Movimiento Ciudadano’s challenge as a question of legality rather than constitutional review.

Overview

  • The Veracruz authorities were instructed to begin recounting 51 ballot packages at 9:00 a.m. on September 10 to verify the municipal result.
  • Initial certification gave Movimiento Ciudadano’s Emilio Olvera 15,384 votes against Morena’s Adanely Rodríguez with 14,884, a 500-vote margin equal to 0.8%.
  • Morena requested a full recount citing alleged irregularities and violence during the June 1 election.
  • Movimiento Ciudadano argued the recount request was improperly filed by the candidate and submitted late, but the Sala Superior declared those appeals inadmissible.
  • Magistrates Reyes Rodríguez Mondragón and Janine Otálora dissented, and authoring magistrate Gilberto de Guzmán Bátiz noted chain-of-custody claims could be pursued through later challenges.
