Telangana High Court Shields IAS Officer Smita Sabharwal From Action Over Kaleshwaram Report

The court will take up her challenge with earlier petitions on October 7.

Overview

  • The division bench led by Chief Justice Aparesh Kumar Singh and Justice G. M. Mohiuddin ordered that no adverse action be taken against Sabharwal based on the P. C. Ghose Commission findings until the next hearing.
  • Sabharwal’s petition seeks to quash the report’s remarks against her, alleging violations of Sections 8-B and 8-C of the Commissions of Inquiry Act and stating she was not part of decision-making on the barrages.
  • The Ghose Commission’s July 31 report termed her negligent for failing to ensure Business Rules compliance, cited her site visits and administrative involvement, and recommended action for not placing key files before the Cabinet.
  • Her case will be heard alongside petitions by K. Chandrasekhar Rao, T. Harish Rao, and former chief secretary S. K. Joshi, who previously received similar interim protection.
  • The Telangana government has referred the matter to the CBI for investigation into alleged irregularities and embezzlement, and the state informed the court it is not presently contemplating action against her.
