TCU Fixes Federal CBS Reference Rate at 11.3%

The tribunal’s calculation preserves federal consumption revenue and is now before the Senate whose resolution can change final tax burdens through later regulatory choices.

Overview

  • The Tribunal de Contas da União approved a reference alíquota of 11.3468% (rounded to 11.3%) for the federal Contribuição sobre Bens e Serviços and set a 44.16% redutor for public procurement before sending its report to the Senate.
  • The TCU’s calculation, which used 2023–2024 as base years, folded about 60% of the IPI loss into the CBS while assuming the new Imposto Seletivo will replace roughly 40% of IPI revenue, a split that raised the CBS estimate by just over one percentage point.
  • The Ministry of Finance says exemptions, sector reductions and the cashback mechanism should push the CBS’s average effective rate below about 8.5% in 2027 after reliefs are applied.
  • Three unresolved regulatory items—statutory rates for the Imposto Seletivo, the definitive IPI residual list for the Zona Franca de Manaus, and the rules for créditos presumidos—could raise or lower the required reference rate if altered by the Executive or Congress.
  • The TCU’s report must be acted on by the Senate by December 15 or the tribunal’s figure will stand, and the government plans a provisional measure on the Imposto Seletivo while renewing a one‑month diesel subvention of R$2.12 per liter.
