TABC Adopts Emergency 21+ Rule for Hemp-Derived THC Sales

The move implements Gov. Greg Abbott’s directive to regulate the market rather than prohibit these products.

Overview

  • The emergency rule takes effect once posted to the Texas Register, with enforcement beginning Oct. 1.
  • Retailers must verify a valid, unexpired government photo ID at the point of sale and cannot sell to customers under 21.
  • License holders who violate the rule after Oct. 1 face license revocation, with limited defenses for reasonable belief or misrepresentation by a minor.
  • The action currently applies to TABC licensees, and the agency is working with DSHS to reach hemp retailers outside TABC’s licensing.
  • The rule lasts up to 180 days as formal rulemaking proceeds, against a political backdrop in which Lt. Gov. Dan Patrick continues to push for a total ban.
