Supreme Federal Court Unanimously Upholds Bolsonaro Conviction as Appeals Window Narrows

The ruling leaves only narrow, time-bound appeals before sentences can be executed.

  • Brazil’s Primeira Turma rejected Bolsonaro’s and six allies’ embargos de declaração in a unanimous virtual vote, maintaining the convictions in the attempted coup case.
  • With the acórdão expected shortly, defenses have five days to file new clarification appeals and a remaining window for embargos infringentes that are procedurally unlikely because only one minister voted for acquittal.
  • Sentences will be enforced only after trânsito em julgado, so the seven appellants remain free until any remaining appeals are resolved.
  • Relator Alexandre de Moraes will rule on the admissibility of further filings, may dismiss dilatory motions, and will set custody conditions and locations for sentence execution.
  • If imprisonment is ordered, Bolsonaro could be sent to the Papuda complex or a special Federal Police room, military and police co-defendants may go to barracks or special wings, and his defense could seek house arrest on health grounds; Mauro Cid already serves an open-regime sentence after a plea deal.
