The cases will determine if state bans on transgender women’s participation in girls’ sports conflict with the Constitution’s equal protection clause.

Overview

  • On July 3 the Supreme Court granted review of Idaho’s and West Virginia’s laws and will hear oral arguments when its October term begins.
  • Idaho’s 2020 Fairness in Women’s Sports Act and West Virginia’s 2021 law bar transgender women and girls from female teams based solely on birth-assigned sex.
  • Boise State student Lindsay Hecox and 15-year-old Becky Pepper-Jackson each hold injunctions that allow them to compete in girls’ sports while litigation continues.
  • The Ninth and Fourth Circuits blocked enforcement of the bans, finding they likely violate the 14th Amendment’s equal protection guarantees and Title IX’s prohibition on sex discrimination.
  • A decision expected by mid-2026 could set a nationwide precedent for more than two dozen similar transgender athlete restrictions.
