Supreme Court to Assign Bench for Challenge to UP’s Banke Bihari Temple Ordinance

Chief Justice of India will consolidate overlapping pleas to review whether the ordinance breaches the temple’s 1939 governance scheme

Overview

  • The Thakur Shree Banke Bihari Ji Maharaj Temple Management Committee filed a petition on July 27 challenging the state’s 2025 ordinance vesting administrative control of the Mathura-Vrindavan shrine in the Uttar Pradesh government.
  • The petition alleges the ordinance violates separation of powers and preempts a Public Interest Litigation pending before the Allahabad High Court under Article 213 of the Constitution.
  • On May 15, the Supreme Court modified an Allahabad High Court order to permit the state limited use of temple funds for a development corridor, provided acquired land is held in the deity’s or trust’s name.
  • Justice Surya Kant directed that overlapping challenges, including those before another Supreme Court bench and the Allahabad High Court, be consolidated under a single hearing.
  • Proceedings continue in the Allahabad High Court where a parallel suit also contests the government’s attempt to take over the temple’s private management.
