Overview

  • The Chief Justice B. R. Gavai–led bench on Monday refused to advance the case, noting it is already scheduled for October 10.
  • The court said it is currently occupied with a constitutional bench hearing on a presidential reference, so an earlier listing is not possible.
  • On August 14, the Supreme Court asked the Centre to file its reply within eight weeks and underscored that events like the Pahalgam attack must be considered.
  • In its December 11, 2023 judgment, the court upheld the Article 370 revocation, directed assembly elections by September 2024, and said statehood should be restored at the earliest.
  • Elections were held in September 2024 and the NC formed government, but statehood remains pending as a 2025 reorganisation bill is silent on restoration and earlier amendments expanded the lieutenant governor’s powers.
