Supreme Court Reserves Verdict on Justice Varma’s Challenge to Lok Sabha-Impeachment Inquiry Panel

The bench will decide if any procedural defect is prejudicial enough to halt the parliamentary probe into cash found at the judge’s residence.

Overview

  • During hearings, the court indicated there is prima facie no bar under the Judges (Inquiry) Act on the Lok Sabha Speaker forming the committee after the Rajya Sabha declined to admit a similar motion.
  • The Lok Sabha secretary general told the court the Rajya Sabha notice was never admitted and was found defective, with the Deputy Chairman rejecting it on August 11, 2025.
  • The bench asked that the Rajya Sabha secretary general’s note, which appeared to venture into the merits, be supplied to Justice Varma for his response.
  • Justice Varma argues Section 3(2) required a joint committee since notices were filed the same day, and he contests the Deputy Chairman’s authority to reject the Upper House motion.
  • The three-member committee led by Justice Aravind Kumar has issued notices seeking a written defence by January 12 and a personal appearance on January 24, following an earlier in-house inquiry that found sufficient substance in the charges.
