Supreme Court Redirects Amritpal Singh’s NSA Challenge to Punjab and Haryana High Court

Singh has been held under the National Security Act since April 2023, even after winning the Khadoor Sahib Lok Sabha seat from jail.

Overview

  • A bench of Justices Aravind Kumar and N.V. Anjaria declined to hear the writ petition and granted liberty to approach the Punjab and Haryana High Court, requesting a decision preferably within six weeks.
  • The bench indicated it could otherwise list the matter only in early 2026, so it sought expedition consistent with the court’s view that time is critical in detention cases.
  • Senior advocate Colin Gonsalves argued the detention stems from a single FIR with a chargesheet already filed, while Additional Solicitor General S.V. Raju said six weeks may be too short for filings and replies.
  • The Waris Punjab De leader remains lodged in Dibrugarh Central Jail following his April 23, 2023 arrest under the NSA, with reported extensions in April 2024 and April 2025.
  • Prison security concerns have intensified after Dibrugarh jail superintendent Nipen Das was arrested for allegedly supplying devices that Assam Police say enabled Singh to access the internet.
