Supreme Court Quashes FIR in Lakshya Sen’s Birth Certificate Forgery Case

The apex court found criminal proceedings lacked fresh evidence, amounting to abuse of legal process.

Overview

  • The bench of Justices Sudhanshu Dhulia and Aravind Kumar set aside the FIR against Sen, his parents, brother Chirag and coach U Vimal Kumar over alleged fabrication of birth records.
  • It ruled that without any new material, continuing prosecution under IPC sections 420, 468 and 471 would constitute an abuse of judicial process.
  • The FIR was registered in December 2022 by Karnataka Police after M G Nagaraj’s private complaint claimed certificates were altered to reduce the players’ ages by roughly two-and-a-half years.
  • Earlier verifications by the Sports Authority of India and a Central Vigilance Commission review in 2016 upheld the official birth years based on bone ossification and dental tests.
  • Lakshya Sen welcomed the verdict, saying he was thankful for the conclusion and will now devote his full attention to his badminton career.
