Supreme Court Probes Alleged Evidence Suppression in Sonam Wangchuk NSA Detention

The bench signalled that proven withholding of key videos could vitiate the detention.

Overview

  • Senior advocate Kapil Sibal played clips in court of Wangchuk urging protesters to stop violence and alleged that authorities withheld these videos from the detaining magistrate.
  • Sibal said four videos cited in the September 26, 2025 detention order were not supplied to the detainee in time or in usable form, undermining his right to make an effective representation.
  • A bench of Justices Aravind Kumar and Prasanna B. Varale indicated that if suppression of material is established, it may not need to examine other challenges to the detention.
  • The Ladakh administration has defended the NSA action as necessary after the September 24 Leh unrest and maintains that the grounds and material were duly communicated, with the advisory board affirming the decision.
  • The Supreme Court posted the matter for further hearing on January 12, and Wangchuk remains in Jodhpur Central Jail following his September 26 detention.
