Supreme Court Orders Noida Medical Board Review of Passive Euthanasia Plea Within Two Weeks

The bench invoked its Common Cause precedent to trigger a hospital board review that will guide any decision on withdrawing life-sustaining treatment.

Overview

  • Justices JB Pardiwala and KV Viswanathan directed the District Hospital in Sector 39, Noida to constitute a Primary Medical Board and submit its report within two weeks.
  • The board has been asked to assess whether life-sustaining treatment for Harish Rana may be lawfully withheld under passive euthanasia guidelines.
  • The court noted that Rana remains in a persistent vegetative state with 100% disability and is being kept alive through PEG feeding.
  • If the Primary Board supports withdrawal of treatment, a Secondary Board may be formed for independent confirmation before further judicial orders.
  • The directive follows a renewed plea by father Ashok Rana, after the Supreme Court declined withdrawal in 2024 and the Delhi High Court earlier refused to refer the case to a medical board.
