Supreme Court Orders National Policy and Uniform Rules for Organ Transplants

The bench directed the Centre to address state-level disparities through model allocation criteria.

Overview

  • The court instructed the Union government to consult States and NOTTO to frame a national policy with model allocation criteria that tackle caste and gender bias.
  • States were pressed to adopt the pending legal framework, with Andhra Pradesh urged to implement the 2011 THOTA amendments and Karnataka, Tamil Nadu and Manipur told to adopt the 2014 rules.
  • The Centre was asked to constitute State Organ and Tissue Transplant Organisations in Manipur, Nagaland, Andaman and Nicobar Islands and Lakshadweep.
  • Birth and death registration forms are to be amended to note brain death and whether families were offered the option to donate organs.
  • The government must draft live-donor welfare guidelines to prevent exploitation, with the bench also flagging concerns about organised crime in organ procurement.
