Supreme Court Orders FIR, Shifts Probe to Delhi Police in Case Against Ex-CBI Officers

The bench set a three-month timeline, affirming that investigators are not above scrutiny.

  • The Supreme Court upheld Delhi High Court directions to register FIRs against Neeraj Kumar and Vinod Kumar Pandey over alleged intimidation, forgery and abuse of authority from 2000–2001.
  • It reassigned the inquiry from the Delhi Police Special Cell to the Delhi Police, mandating an investigating officer not below the rank of Assistant Commissioner of Police.
  • The court asked that the investigation be concluded expeditiously, preferably within three months, citing the prolonged pendency.
  • Protection from arrest was granted conditional on the officers joining and cooperating with the probe, with custodial interrogation left to the investigating officer’s recorded satisfaction.
  • Complaints by Sheesh Ram Saini (2001) and Vijay Kumar Aggarwal (2004) were found to disclose cognisable offences under IPC sections including 506, 341, 342, 166, 218, 463, 465, 469 and 120-B, with the IO free to file a closure report or a chargesheet.
