Supreme Court Orders ECI to Publish Names and Reasons for 65 Lakh Omitted Bihar Voters

Ensuring transparency in the Special Intensive Revision, the interim order grants omitted electors a clear path to challenge their exclusion before the final list is published

Overview

  • A bench led by Justices Surya Kant and Joymalya Bagchi directed the ECI to release district- and booth-wise lists of about 6.5 million voters omitted from Bihar’s draft rolls by August 19, detailing reasons for each exclusion
  • The lists must be searchable by Electors Photo Identity Card (EPIC) numbers and widely publicised online, in newspapers and on notice boards at district and panchayat offices
  • Omitted electors will be allowed to file claims for re-inclusion using Aadhaar or EPIC cards as valid identity proof during the August 1–September 1 claims window
  • The ECI is required to submit a compliance report on these directives by August 22 as the Court continues to review challenges to the Special Intensive Revision
  • While affirming the ECI’s authority under Section 21(3) of the Representation of the People Act, the Court warned it will intervene if the exercise undermines voter rights or lacks transparency
