Supreme Court Opens New Term With Trump Tariffs and Firing Powers on the Line

The term tests how far the conservative majority will permit unilateral presidential power.

  • The Court begins Oct. 6 with a Nov. 5 hearing on challenges to President Trump’s sweeping tariffs after a lower court found he exceeded authority under an emergency law, raising major-questions doctrine implications.
  • Justices will hear in December whether Congress can restrict removals of independent-agency leaders, a case that invites reconsideration of Humphrey’s Executor after the Court let the FTC firing of Rebecca Slaughter take effect pending review.
  • In January, the Court will weigh Trump’s attempt to remove Federal Reserve Governor Lisa Cook, keeping her in office for now as it considers the scope of “for cause” protections and the Fed’s distinct legal status.
  • Over the summer the conservative majority repeatedly granted emergency relief to keep administration policies in place, and several of those disputes have been fast-tracked for full merits rulings this term.
